This Privacy Policy explains how Nexaria Digital (nexariadigital.com), operated by Smith Medical, P.C. ("Nexaria," "we," "us," or "our"), collects, uses, discloses, and safeguards information when you use our Web3 digital-asset marketplace and related websites, applications, and services (collectively, the "Services").
We are committed to handling your information responsibly and transparently. Please read this policy carefully. If you do not agree with it, please do not use the Services.
Who We Are
Nexaria Digital is a marketplace to manage, list, sell, rent, lease, and advertise digital assets. The Services are provided by Smith Medical, P.C. If you have questions about this policy or our data practices, contact us at privacy@nexariadigital.com or through our contact page.
Information We Collect
Information You Provide
- Account information. When you register, we collect your name, email address, password credentials, and profile details you choose to add.
- Listing and marketplace content. Titles, descriptions, images, pricing, and metadata you submit when listing or advertising digital assets.
- Communications. Messages, support requests, and feedback you send to us or to other users through the Services.
- Payment information. When billing is enabled, payments are processed by our payment provider. We do not store full card numbers on our own systems.
Wallet Addresses and On-Chain Data
If you choose to connect or reference a blockchain wallet, we may collect your public wallet address and associated on-chain transaction data. Wallet addresses are pseudonymous, publicly available data recorded on public ledgers such as the XRP Ledger (XRPL) and EVM-compatible networks. We do not collect your private keys, seed phrases, or recovery credentials, and you should never share them with us or anyone else.
Information Collected Automatically
- Usage data. Pages viewed, features used, referring URLs, timestamps, and interactions with listings.
- Device and log data. IP address, browser type, operating system, and device identifiers.
- Cookies and similar technologies. See our Cookie Policy for details on how we use cookies and how you can manage them.
How We Use Information
We use the information we collect to:
- Provide, operate, maintain, and improve the Services;
- Create and manage your account and authenticate you;
- Facilitate listings, marketplace activity, advertising, and communications;
- Process subscriptions and transactions where billing is enabled;
- Send service, security, and transactional messages;
- Send marketing communications where permitted (you may opt out at any time);
- Detect, prevent, and address fraud, abuse, and security incidents;
- Comply with legal obligations and enforce our terms.
Legal Bases for Processing (EEA/UK)
Where the EU or UK General Data Protection Regulation applies, we process personal data under the following legal bases: performance of a contract (to provide the Services you request), legitimate interests (to secure, improve, and market the Services in a proportionate way), consent (for optional cookies and certain marketing, which you may withdraw at any time), and legal obligation (to comply with applicable law).
How We Share Information
We do not sell your personal information for money. We may share information with:
- Service providers (processors) who perform services on our behalf, including Supabase (database and backend infrastructure), Clerk (authentication and identity), Stripe (payment processing), Resend (transactional email delivery), and Vercel (hosting and content delivery). These providers are contractually bound to protect your data and use it only to provide their services to us.
- Other users, where you publish listings, advertisements, or public profile content.
- Legal and safety recipients, when required by law, legal process, or to protect rights, property, or safety.
- Business transfers, in connection with a merger, acquisition, or sale of assets, subject to this policy.
International Data Transfers
We and our service providers may process information in countries other than where you live, including the United States. Where required, we rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses to protect information transferred across borders.
Data Retention
We retain personal information for as long as your account is active or as needed to provide the Services, comply with legal obligations, resolve disputes, and enforce agreements. Public on-chain data recorded on blockchains is outside our control and generally cannot be deleted or altered by us.
Your Privacy Rights
GDPR (EEA/UK) Rights
Subject to applicable law, you may request access to, correction of, deletion of, or a portable copy of your personal data; object to or restrict certain processing; and withdraw consent. You also have the right to lodge a complaint with a supervisory authority.
CCPA/CPRA (California) Rights
California residents may request to know the categories and specific pieces of personal information we collect, request deletion or correction, and opt out of any "sharing" of personal information for cross-context behavioral advertising. We do not sell personal information for monetary value. We will not discriminate against you for exercising these rights.
To exercise any right, email privacy@nexariadigital.com or use our contact page. We will verify your request before responding.
Security
We use administrative, technical, and organizational measures — including encryption in transit, access controls, and reputable infrastructure providers — designed to protect information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
Children's Privacy
The Services are intended for adults 18 years of age or older. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us information, contact us and we will delete it.
Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the updated policy.
